Rental Agreement, Liability Waiver & Refund Policy

Customer certifies they are 21 years of age or older and will present a valid government-issued photo ID at delivery. Delivery may be refused, with no refund, if no one present is 21+ or if valid ID cannot be produced.

Customer will not allow anyone under 21 to use, handle, or be exposed to the hookah, tobacco/shisha product, coals, or heating equipment. Customer is solely responsible for verifying the age of every guest.

All hookahs, hoses, bases, bowls, trays, tongs, coal heaters, and bags remain the exclusive property of Bacano Hookah Xpress and are rented, not sold. Customer takes full care, custody, and control of the equipment from the moment of delivery until it is physically picked up by our team.

Customer is responsible for using the equipment correctly and following all instructions provided at setup. Customer agrees to pay the full replacement cost of any equipment that is lost, stolen, damaged, broken, burned, or not returned, plus any cleaning cost beyond normal use. Equipment may not be moved off-site, resold, sub-rented, or loaned to anyone.

Do not attempt to repair, modify, or disassemble the equipment. Return everything in the Bacano bag as-is — no cleaning required.

Coals reach extremely high temperatures. Customer agrees to: keep coals, heaters, and the hookah on a stable, heat-resistant, non-flammable surface away from children, pets, curtains, furniture, and anything flammable; never leave lit coals unattended; use the provided tongs at all times; fully extinguish coals in water before returning the equipment; and use the equipment only in a well-ventilated area.

Smoking is hazardous to your health. Hookah smoke contains nicotine, carbon monoxide, tar and other harmful substances. Do not use if pregnant, nursing, or if you have heart, respiratory, or other medical conditions. Never use while intoxicated, impaired, or operating a vehicle. Do not share hoses if you are ill.

Customer knowingly and voluntarily assumes all risks arising from the rental, handling, and use of the equipment, including but not limited to burns, fire, smoke inhalation, carbon monoxide exposure, nicotine effects, illness, property damage, and personal injury or death.

Customer hereby releases, waives, and forever discharges Bacano Hookah Xpress, its owners, employees, contractors, drivers, and agents from any and all claims, demands, damages, actions, or causes of action of any kind resulting from the rental or use of the equipment, whether occurring to Customer or to any guest.

Customer agrees to indemnify, defend, and hold Bacano Hookah Xpress harmless from any claim, loss, fine, or expense (including attorney's fees) brought by any guest, neighbor, venue, landlord, or third party arising out of Customer's rental or use of the equipment.

All equipment and products are provided "AS IS" and "AS AVAILABLE," with no warranty of any kind, express or implied, including without limitation any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant uninterrupted enjoyment, specific flavor performance, session duration, or that the equipment will be free of defects.

To the maximum extent permitted by Florida law, the total liability of Bacano Hookah Xpress for any claim arising out of or related to a rental shall not exceed the amount actually paid by Customer for that specific order. Bacano Hookah Xpress shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost enjoyment, or damage to property, however caused.

Customer is responsible for providing an accurate address, safe access, and lawful permission to use hookah equipment at the location (including HOA, apartment, venue, hotel or park rules). If our driver cannot safely deliver, access the location, or if anyone at the location is hostile, unsafe, or unable to show 21+ ID, the order may be cancelled with no refund.

Customer must be available for pickup at the agreed window. Failure to return equipment at pickup may result in additional rental charges and replacement fees.

• 24+ hours before your reserved time: full refund (100%).
• Same day, before the driver is out for delivery: 50% refund.
• After the driver is out for delivery: no refund.
• After the equipment has been delivered: no refund, for any reason, including early return or unused bowls.

Refunds are issued to the original payment method and may take 5–10 business days to appear. Delivery/mileage fees and taxes follow the same schedule. Loyalty reward orders have no cash value and are not refundable. If we cancel due to weather, safety, or unavailability on our end, you receive a full refund.

This agreement is governed by the laws of the State of Florida. If any provision is found unenforceable, the remaining provisions stay in full force. These terms may be updated at any time; the version in effect at the time of your order applies.
